I believe you missed this part "has now filed a supplemental Statement of Claim and requested a final hearing date be set in the arbitration matter". Were you also aware the company "will be seeking an award in excess of $100 million at the final hearing"?
No, it does not mean they haven't responded to the FDA . It only means they haven't received a response. We won't know until the cc as to whether they've submitted the response.
