The court decided that in that specific case to forestall the parent company from interfering. The arbiter may decide NSF is not a party and is more likely to do so since the initial contracts predate their acquisition and are solely between Cytodyn and Amarex.
Cytodyn could bring a civil suit after the arbitration to include NSF especially if the buyout contract of Amarex includes assuming Amarex's liabilities. But would it really be worth the effort when the court case could go on for years and the remuneration from an FDA approval would dwarf any payout.
Personally, I think the destruction of Amarex due to their own incompetence and a prison term for Kazempour due to his own stupidity are satisfaction enough.
