Well done Jake (and Respert). I think you're onto something.
As far as establishing the idea that a successful combo trial with Leron would be "unexpected," you are dead on in pointing at the FDA letter disparaging Nader's claims. That letter read (in small part):
That letter was noxious, misleading, errant, misguided, and destructive to the lives of both millions of American and (more importantly) the fortunes of Respert and me. Wouldn't it be neato if that falsehood, in the end, works out to our advantage -- because the letter makes any claim by Merck that success in combo w/ Leron would certainly be "unexpected"?
