As that letter was written in 2009, that says to me the SEC is not going to do anything about naked shorting. I hadn’t realized it was even a problem in 2009. It seems like companies are realizing the SEC won’t take any action so they are doing their own investigations to identify those behind the naked shorting and pursue legal action against them.
