It remains to be seen. There has been significant litigation including a Supreme Court ruling on this matter in 2016 and enhancements in reporting requirements via blue sheet data from the brokers to report into the DTC as an attempt to minimize ex-clearing events. Also, tokenization, swaps, and other derivative conversion vehicles used to hide these Fails to Deliver are where it becomes very interesting. Does the blockchain ledger have a stop sign? Is there enough litigation and rules to influence a real change in the financial system? Will the governance of this matter be taken seriously enough to defend the national security of the United States?
