I think Amarex being a licensed CRO is a huge impact on their responsibilities. Would you hire a CRO that is not Licensed? Would a License be issued to a company that does not posses the protocols, ability and QC to make sure the standards are met? of course not. Cytodyn hired Amarex to do a job they were licensed and they were paid to do. they did not do their job repeatedly. Just because they told Nader they can't get it done does not mean Cytodyn is to let it slide. Amarex is obligated to do what they are paid to do and licensed to do because they agreed to do so.
As for losing their license for submitting incomplete work costing their client hundreds of millions of market cap and lost time to market, i think that should be obvious.
again, the history of emails will tell the story. I still believe Nader was too optimistic and selling an impossible story as well as Amarex doing a crap job. They can both point the finger but both had the power to do the right job and they failed.
