With regard to litigation and recovery of damages with Amarex, I very much like our chances. Granted I'm out of my league here, but common sense
dictates we were terribly harmed.
And that's coming from what might be considered the ultimate in star & expert witnesses - the FDA who described the BLA as "woefully incomplete", "missing key data" and Amarex "knowingly signing off and submitting incomplete BLA" and so on--
Maybe not the best analogy, but if a patient checks into a hospital for routine surgery and checks out severely damaged goods ( injured) - you not only sue the physician, but the hospital & any parent company entity.
