You are 100% right, CYDY cannot "waltz in with 9 years of good data and dominate the HIV market" because they need a viable BLA to do so, and it is NOT the FDA's fault that this has not happened.
If you want to blame the FDA and believe there is a mass conspiracy, that's perfectly fine, but CYDY didn't deliver (yet) and the FDA is not to blame for that.
In no way do I believe that what Nader did makes CYDY untouchable. It may make CYDY impossible to recover from the damage due to lack of financing, but that is different and I hope it is not the case. Many companies (with money) have been rocked by scandal worse than what Nader did and still survived.
