So i will assume that this investigation has been going on for the past 2 years and the DOJ would not indicte Nader and Kaz if they did not have solid evidence. But i want to review our history with this in more detail, because the indictment reads little too much like a basher wrote it and there was info around this that is not brought up yet. I have no doubt Nader and Kaz will claim innocent. I don't want to sound like a supporter of them at all - i am not and am very pissed off if this was what was going on.
This is what I remember:
Filing the incomplete BLA was known by Kaz and was Nader being frustrated at how long it was taking. We assumed it was Nader trying to get Kaz to get it done. We also have rolling review and it was explained verbally i think by Nader that the missing parts would be added in later. still not complete filing of the BLA, but sort of a rational thought. I also remember that the date on the email from Nader was weeks before the actual BLA filing, so Kaz did not file the BLA that week as Nader told him to do. I can only assume Kaz was working on completing it further rather than just sending it to the FDA no mater the completeness.
As for Nader selling shares, I never understood His explanation for this. He said something to the effect that he sold shares to put some financial benefit to Cytodyn for a bill from Samsung. I did not understand how share he got for $.01 would put any money in Cytodyn and did not see any investment into Cytodyn with Nader's cash. It really made no sense and this is likely what is really putting Nader in hot water. We all know Nader never bought shares on the open market and complained that this transaction cost him a large tax bill.
I don't see how Kaz and Nader were conspiring, what was the gain for Kaz? it is costing him his company and reputation to ever work in the industry and I don't see any cash for him in this scheme. Nader can claim he did not know how incomplete the BLA was, Kaz can now claim he told Nader it was not done but it is impossible to explain the stock sale by Nader.
Anyone remember how much cash went to Nader for this stock sale? wasn't it $2-3 mil? And if Nader knew this would tank the stock from the RTF, why was he deep in manufacturing with Samsung? seems like he honestly thought the BLA would go through?
As for the Covid smoke and mirrors, I don't think it was wrong to think small trials with the data we saw that the FDA might give an EUA. I honestly think Nader believed this. Was moving fast better than waiting for better trial design - not sure. there is no stock sales from Nader during covid, jus the sale after the BLA.
It is a fine line between cheerleading by the CEO and false statements. This is going to drag on for months at least. I have no idea how this effects the arbitration with Amarex but i doubt actual cash will be in Cytodyn's checkbook from that for a long time.
I just don't understand why a drug so effective an safe can be this difficult to get approved. seems like the past years have been finding the most soap opera way of screwing things up.
