It hasn't been dismissed. The parties went to private arbitration but couldn't come to an agreement so they've been given more time to try to reach a settlement by the aptly named Judge Benjamin Settle.

I'm guessing the company won't be responsible for the entire amount of the settlement if there is one because Nader and Mulholland are co-defendants with the company and Kelly but maybe somebody else has an idea about that.

Here is the complaint. It's all Nader-led bullshit and has nothing to do with the current direction of the company.
