Has anyone determined whether D&O liability insurance has kicked in for Amarex/ NSF?? I assume it has, given the very apparent malpractice of Amarex. IMO insurance companies prefer settlement agreements, without liability admissions, especially as here, where there is likely no lost sales damage calculation and damages are likely to be limited to actual expenses paid and duplicate future expense of repeat professional services. Short of settlement, however, look forward to a minimum of 5+ years of litigation.

As Cyrus says, focus. Litigation is not focus - it is a crapshoot/timewaster.
