No need to say "it's in arbitration and we can't discuss it" because we already KNOW it's in arbitration and, by definition, they can't discuss it.
They've already said that they are trying to tease out the data from the raw garbage that Amarex supplied. Given how badly Amarex messed up the data -- not keeping proper records, etc (**allegedly**), it does seem to be taking a long time. No reason they can't use the data once they get whatever can be salvaged.
