I think you may be unfamiliar with the evidentiary rule in civil cases that one can "plead the Fifth" if a question is asked that may tend to incriminate the deponent. In many jurisdictions, there are certain presumptions that the trier of fact may make in that event, but in any event, the witness could decline to answer on that basis.
Besides, there also are rules for where a person can be sued, and I can't say I feel like the time and expense of traveling to FL just to find out nothing, and obtain an uncollectible judgment. If Dirty Joe is not participating in the BK action, what makes you think he would subject himself to and participate in a civil suit?
As far as what Dirty Joe's wife may have said about his current job status, she also said that (although essentially penniless and not having any income from GNBT/NUGX) he was entertaining various other ladies lavishly. Never did find out the explanation for that apparent inconsistency...but then, I suspect there are a lot of inconsistencies lurking about in Dirty Joe's shadow.
