Lawyers of the caliber of Sidley Austin will have no problem tying NSF to Amarex.
NSF appointed some of their executives to Amarex in active management roles. Their CEO talked to Nader and said they would "investigate" what was going on with Amarex.
Either one of those would be sufficient to prove that NSF had some direct control of Amarex and its actions.
NSF will not be able to claim that they had no involvement and are not responsible.
CYDY's big bargaining chip is -- who would want to hire Amarex OR NSF if what Amarex did, either from incompetence or actual malice, were widely known? What do you think a nice article about this in, for instance, Forbes, or the NY Times, would do to NSF's business? Do you think that Sidley Austin would be shy about publicizing this?
