You don’t seem to grasp the whole of what happened or what is currently happening. There is no lawsuit happening right now for damages. They are in arbitration and trying to prove damages and having a mediator controlling the situation and exposing the contract agreement and any laws broken. So quit saying they will recover nothing from a lawsuit because there is no lawsuit at least at this time. If Sidley can prove gross negligence ( this is likely) there just may be a lawsuit down the road if Sidley doesn’t like what is offered in arbitration. I believe Cytodyn is holding all the cards and if you have no proof they don’t… then our conversation is over. Evidence is everything sometimes. Especially in your elaborate beliefs of a inconsequential email. You keep trying to give it weight but it will end up having absolutely no bearing on anything. The timing of the email explains it away if you want to use common sense as a guide.
As for you to bank on everything you believe on a email that didn’t hold its own weight in court is no evidence of lying or a omission of Nader knowing that the BLA was not complete. Nader himself said the email was taken out of context and was clearly a month before the filing of the BLA and could of been just used for motivation to get the damn job done and he was tired of the delays and moving the completion date of filing as he should of been. Wouldn’t anyone threaten Amarex at this point when they have postponed the BLA a couple of times already? So for you to tie the email to any premise that it had or will have any meaning going forward is just foolish. It’s not real and you have no evidence that will hold water. I said show me evidence.
