Note about a case that's dissimilar to Amarex and CYDY
I lost a lot of money on a lawsuit filed and won by Pharmathene against Siga Tech. I won't go into the details, but there's one thing to mention. The amount of the settlement (vis the Delaware Supreme Court) was based on "expectation damages" -- damages based on lost profits. And those expected profits were over 5 years in the future when the suit was filed. (When the suit was filed, there was no guaranteed market at all for the drug in question!)
So I think that CYDY can claim "expectation damages" based on the profits that would have ensued if Amarex had done its job. We all know the many ways that CYDY would have been better off the FDA had approved the BLA. Let's start at a billion bucks....
