a "gag order" (if at work) would only restrict or keep him from talking about his own company affairs, it does not tell him to "shut up entirely". This does not force him into a "vow of silence".
So, in my view, it is absolutely possible, that he is "gagged" in regards to talking about his own business, but is surely free to share his opinion on the competition.
One is the (possible) orders that Joe Moscato, CEO of GNBT/NGIO, has, and the other is the freedom of JM, a private person, to let people know his opinion on whatever he puts his mind to. The US still has the "freedom of speech" right?
In regards to "many shareholers are losing tons of money". I AM ONE OF THESE SHAREHOLDERS, and that BIG TIME, as of now. So trust me, I do not find this by any means funny, to be in this specific situation. I additionally have suggested an investment in GNBT to my parents, and they keep asking me if there are news, basically every time we speak! Not fun to keep answering these questions to my dad, who is "not amused".
