Time for a Sidley Austin Motion to Dismiss, followed by a Motion for Summary Judgment on anything that survives that.
And, since they seem to quote him so much, maybe they should attempt to try to take the deposition of Adam Feuerstein. Now that would be interesting if they could force that.
As to Shkreli, they presumably included him in the complaint to attempt to dirty up the company because Vyera Pharmaceuticals, LLC, whom he once ran, entered into a license agreement with CytoDyn for the HIV indication.
