I've always hated these penalties as they seem so arbitrary, purely a punishment for the impatience of biotechs. In reality, if the drug works and hits the p-value by a hair, it seems bananas to hit the math with a penalty which misses the p-value. Instead maybe just hit the company with a monetary fee as a deterrent to peeking at the results early.
It's akin to THE PRICE IS RIGHT, where a contestant gets closest to the right guess, but they're one dollar over and therefore disqualified. Only we're talking hundreds of thousands of lives, not a grand prize of a speedboat or a vacation.
