I will say this about the Complete Silence then probably resume my own Holiday Silence, as I am once again out of things to productively comment on.
There is an extremely deep collective knowledge base and an extremely rigorous collective DD effort from the members of this site. Yet no one has ever seen or found evidence of an "SEC-mandated" silence like this. The fact that this silence could potentially now include not filing required 10-K docs is even more remarkable (Yes, the lack of Ks could also be due to lack of funds or ineptitude, but neither of those can be attributed to the SEC, so those explanations aren't much better).
I put quotes around SEC-mandated because, as of yet, we have no evidence that this silence indeed stems completely from the SEC other than statements from Joe to several members here (myself included).
And what makes me most incredulous is the idea that Joe cannot or will not either make a public statement that the SEC is mandating the silence due to an investigation or request that the SEC post the CORRESP to the company on EDGAR (as I requested in the letter I posted here).
As we have established, it is up to the company whether or not to make any open investigation public. So what could the harm of informing us on the current investigation be at this point, when we're rapidly approaching $0.00? Surely the SEC would not object to the Companies informing us of the investigation that they are conducting purportedly in our interest.
Joe has tried to point the finger at the SEC regarding the silence. But, at least on the issue of informing Shareholders as to the existence and nature of the investigation that has driven our investments into the ground, I point the finger squarely back at Joe.
Speak up, Joe, at least on this matter. Tell us what the SEC has said to you and the Companies. Give us the SEC's correspondence on these matters. If you are not able to do that, demand that the SEC post this information themselves on EDGAR.
If you cannot or will not do that, I have no logical choice but to believe there is something in the correspondence that you do not want Shareholders to see.
