From the bits and bobs I've seen of the current lawsuit it just involves release of the data. The arbitration involves payment owed or not to Amarex. A second lawsuit for damages caused by Amarex would need to occur for monetary compensation. It could be Sidley is also using the current lawsuit to establish the amount of control NSF has over Amarex in establishing liability that accrues to NSF from after the buyout.
