"Normally it's best to shy away from court battles not just because of cost but the mere hint of legal issues, even as the plaintiff, doesn't look good to Investors.
However, from wording in the Sidley response, I believe they are prepping for a tort case for hefty damages and the current criticism of management, (including an email taken most likely out of context) I believe a tort suit against Amarex would have a positive effect.
What would be key in that situation is to establish in the mindset of Investors early on that there is a great likelihood of success on the merits of Cytodyn case against Amarex and it appears through first this injunction and if winning an arbitration decision, that is how they will sow trust amongst the SH that a tort case is warranted."
