The 13d group will probably wait until the last minute to file an appeal like they did for the 13d filing. Then when the clerk is handing the judge the appeal papers.
The judge will laugh and says is this the appeal here? You know you don’t have a court approved time on the docket today This appeal has all the information left out? When are you going to learn you dumb bastards! The paperwork “is” the most important part of lawsuits. Wasn’t there a retired lawyer that was part of this group? Did you get rid of your high dollar law firm? Why is this little old guy (Rosenbaum) here representing this group?
Rosenbaum replies. Yes your honor. We ran out of funds for an appeal and nobody wanted to buy more convertible notes from IncellDX to help fund our appeal. We are having trouble raising even the filing costs. Patterson and I are footing the filing fees on our pride and belief that you screwed up. (Rosenbaum was never good at hiding his feelings.)
Rosenbaum: So your honor, can you see it my way and read what I wrote for the appeal on the napkin at breakfast this morning that I had with the last two investors still included in todays appeal. Your honor the napkin tells it all. We were never going to purchase IncellDX if we were successful in the hostile take over. Notice where it says NADA? That’s the affirmation of not going to buy IncellDX… Just so you know… Patterson’s emails about being acquired by Cytodyn were just jokes we were playing on the group to raise legal funds that we knew we would need. We didn’t feel that the lies that Dr Patterson told the court under oath were that serious and felt you put to much weight on his couple of lies. Just know Dr Patterson has trouble telling the truth on anything but we try to not hold it against him. He comes across so nice… so we overlook his lying. When we catch him stealing we just slap him on the back of his hand and he gets the message. We still like him plenty though.
Judge: Gives disgusted look and says: is this everything you want to dispute included on this little napkin?
Rosenbaum: Yes it is your honor… we had to use half of the napkin to clean up a spill this morning. So what do you think judge… can we have a stay so we can stop the annual shareholders meeting? Then progress to all your mistakes you ruled on so we can correct your view with the appeal?
Judge: Well… I am wondering if you are on a temporary pass from the asylum or some kind of facility that might take care of you. Does your friends have anything to add? Do they know if you have a pass to be off the premises of whatever facility you might of came from? No answer…
Judge: Well, I just have to say that you have a habit of not following the rules and filling out proper paperwork to progress your cases. It will be denied and your Injunction for the stay also denied for your appeal. Do you know why? Because you are not suppose to come back to my court for these actions you seek. You need to follow up in another appeals court and you might want to get some legal advice to know where to go from here. I am not going to rule anything today for you and maybe that will be the end of it. As the gavel drops… Bam!
I just had to have some fun at the 13d’s expense. I realize people are tired or them and the subject overall.
Wishing it was the end of the 13d but they are still around causing us trouble and hopefully the next 6 months allows us a break from all the negativity. They will run a campaign to vote against whatever makes sense just to try to trip up the management and force the company to fail. They are not finished with us and we can’t turn our back on them just yet.
Be aware that they will run a campaign against the 200 million shares we absolutely need to further the trials and buy the next big batch of Leronlimab. Before revenue allows us to buy what we need when we need it. Nader promised us minimal dilution with the yes vote on those shares. Nader has done a good job of minimizing dilution in the past. We should feel good about authorizing the 200 million shares. Nobody likes dilution but this is necessary or we fail as a company. There is no way we progress without those shares. Don’t let the Remnants of the 13d group convince you we should vote no on those shares. They are out to make us fail if they can. So they can swoop in and steal Leronlimab… you know it and I know it. Let’s not let it happen. Be smart investors and don’t listen to that group. The next 6 months will be one heck of a ride. We have 16 things to look forward to. Amazing!
