We have a 10Q that was issued and instead of talking about it, we are wasting time arguing about this nonsense.

So, let me start the discussion:

Hey we seem to have a gross margin of 40, notwithstanding the small amount of sales. This seems to be a very good gross margin.

And, since someone will mention all the lawsuits, keep in mind that lawyers don't generally like to sue dying companies, as they want the company to have money to pay out in the end. So, the lawsuits are a vote of confidence by plaintiffs' lawyers that the company is coming into money.
