I appreciate the response as I imagine others do.
I don't understand the context you use re: exemption/waiver.
If the SEC has an inquiry(investigation) currently and the matter is cleared. The S-1 would then be "approved" assuming things are otherwise in order.
Then it is up to the Nasdaq to approve the NGIO listing.
