Here's a fact: 13D is getting sued in Federal court. So the attorney who is fronting 13D gets an additional suit filed in Delaware state court, because the judge in the Federal case seems to be ruling in ways 13D doesn't want.
Fact: yes, lawsuits are expensive. But, if you're an attorney and draw up most of the papers, and have someone else revise it, you've knocked out a lot of legal fees.
Fact: 13D states "CYDY was clearly forum-shopping to avoid the Chancery Court where certain of the Board’s prior misconduct already has been condemned." In fact, 13D is forum-shopping TRYING TO INFLUENCE SHAREHOLDERS VIA PRESS RELEASES with what is in fact a frivolous lawsuit, because it would surprising to have a State court decide that they are the appropriate venue when the issue is already under dispute in Federal court.
