It probably can be used as evidence against the 13D, at least as to the Motion to Expedite.
The 13D are ramming this proxy through at the same time they oppose the the Motion to Expedite. They should be for a quick decision to validate their proxy, yet they jump the gun here and oppose the Motion to Expedite. Very telling of their intentions.
