I have to disagree with you here.
As a lawyer, I welcome witnesses coming forward with helpful information about a case.
This is not the same as the FDA. The lawyers are trying to prove a case against the 13D (or whatever they call themselves now), and the company's lawyers can't try to find something they don't know about.
