The wage claims were thrown out. What is at dispute is the 8.3 million restricted shares that would not be awarded if Pestell was fired for cause. Purposefully delaying the start of a clinical trial certainly would come under "for cause".
Of interest is that Pestell has claimed 8.3 million voting shares in the 13d. Most certainly he has sold all of his other shares and the 8.3 million is reliant upon the disputed shares.
