My belief, based on the vigor with which Cytodyn is defending against the 13D, and the observations of many who understand the legal maneuvering as well as the 13D missteps, is that Cytodyn will overturn the 13D proxy effort.
Cytodyn will continue clinical development, BLA filing, and perhaps strategic partnering.
It may be wishful thinking on my part, but it seems that the 13D will be compelled to go away.
Even if Cytodyn unassailably demonstrates value, the 13D group retains the ability to take over control of Cytodyn with an uncertain outcome.
I am watching the legal procedures with great interest and will watch for the analysis of Jakeflies, Craigakess, and the other attorneys (apologies to any I have forgotten).
