The method of treatment specified in a patent has to be novel and non-obvious. Arguing against Patterson's patent satisfying that criteria is how Cytodyn got his patent application rejected per the complaint against 13D.
To a layperson like me there seems like a huge grey area as to what treatment is non-obvious or not non-obvious but CCR5 inhibitors as a treatment for the covid cytokine storm do seem pretty obvious (I imagine that something like a lenzilumab as a GM-CSF neutralizer would be as well).
