Bruce filed a patent that is based on work done for Cytodyn. from the quick look I took at both patents there are overlapping claims. Someone can file a patent based on work product for someone else, the patent office may even grant it. If Patterson wants to enforce his patent or Cytodyn wants to abrogate Patterson's patent it will come down to lawsuits. Any claim he files for royalties or overturning Cytodyn's patent will lose because his patent is based on work product done for Cytodyn.
