I am guessing that BP used his then un-EFFDA-approved diagnostic tool to measure receptor occupancy (I'm uncertain his test is EFFDA approved yet) which is one of the reasons for the EFFDA's rejection of the BLA.
So the 13d's hero, under contract to do work for Cytodyn, used the work to develop his diagnostic tool for ehich he applied and got a patent for.
