It was definitely authorized by Patterson but it used work he had done as a consultant to Cytodyn. That work product is the property of Cytodyn not Patterson. Which is why he used the subterfuge of an employee from IncellDX rather than under his own name. To use the work product belonging to someone else to file a patent is fraud.
