Re: enemyofpluto #89447
Some ambulance-chaser law firms specialize in these bogus "shareholder" suits not because they ever plan to file suit, but because they want to extract a settlement from the company they attack -- on the theory that a company will pay them a few hundred thousand bucks to go away. It's much cheaper for the company being attacked to pay what is called "greenmail" instead of spending huge resources and time defending against these baseless suits that will NOT prevail in court.

It should tell people something, the fact that many of these PR's that the law firms put out are asking for someone to sign up as the lead shareholder complainant. They don't have a shareholder complaining, they are just saying they plan to sue, to try to get money out of the company. It's their business model.

Why wouldn't someone just sign up to be lead complainant, on the theory that the lead complainant gets a share of the greenmail settlement, or (on the unlikely chance that the lawsuit succeeded) a big portion of the legal award? Because guess what, the complainant has liability if the company were to defend the case, and the judge awarded legal fees to the company. That could result in a liability of hundreds of thousands of dollars for the lead complainant. That is why the initial complainant in the Cellceutix (CTIX, now known as IPIX) case withdrew, when they found out that CTIX wasn't just going to roll over and pay up. CTIX fought and won.

But the huge number of these bogus suits aimed at CYDY, and the unrelenting string of PR's from the same half-dozen firms, seemingly coming out practically daily, "reminding" people that they are planning to maybe you-never-know sometime-in-the-future we-just-might file a suit -- it sure looks like it's a concerted effort to try to discourage shareholders.

I view it as a sign of desperation by the shorts, who know that the drug works.
