My thought is QMC believes it will prevail in Kansas which will help with bringing suit in Texas. My thought is Pasaca agrees.

IMO, K&L Gates will settle in Texas because they can't take the hit of losing to a 2-Person law firm in Houston and losing the chance at "Top Lawyer" Awards they are addicted to which will also be a major hit to their fees and reputation.
