Court cases definitely have an effect on share price +/-.
Court cases are not responsible for Company Senior Executives or Board of Directors for not fulfilling their fiduciary responsibilities by not filling the appropriate quarterly and annual reports on time.
If one is to look at the business acumen and financial acumen of Pasaca Leadership, they are all fully cognizant of the delinquent filings and have allowed it to persist for a reason. A very powerful and compelling reason.

My guess is that it has something to do with the "Government" just guessing because none of us have any evidence either way.
As for the share structure, they found out how many shares were held in strong hands during the "Proxy Fight".
