Most likely the Generex suit was dismissed. Judges usually are on the side of First Amendment rights in such cases even when lies are involved. What would be needed to win would be proof of conspiracy with Joseph Spiegel or others. If Cytodyn can dig up proof of conspiracy not only will they win the civil suit but then the parties involved could face criminal charges.
