He wouldn't apply for an EUA without a decent chance and some small indication that it could be granted conditional EUA, I don't think.
At worst, they're submitting this now, and the FDA can give feedback, CytoDyn can patch holes and address anything else that happens to need addressing, and roll results from CD16 in and re-submit when the time comes. It would be the most prudent use of this time, imo.
