This is speculation, but there is certainly evidence that the information was at hand. On the last call, I think NP finally capitulated and said something along the lines of "we talked about it and decided to just complete the trial."
That is about as close as I have ever heard him to saying, "yes, that is something we could have done differently).
As many have said (and I was never sure if it was entirely accurate): The DSMB is selected by and works on behalf of CYDY.
