The point is, you file for the EUA, so they have to respond to you in writing. Otherwise, the FDA can fall back on saying "Well, they never applied." Dexamethasone failed their primary but still was awarded EUA based on age-adjusted data.

With a government bureaucracy you have to fill out all the forms, period. You can't just go by what someone tells you verbally. They should apply and make the FDA say yes or no.
