#5, because every other possibility seems to imply that the data could be good but CYDY and/or the FDA are sitting on it for some reason, as people die.
That being said, I would modify #5 to say that there COULD be discussions of any of 1-4 going on at the same time, but no, they are not holding up putting out a life saving therapeutic so that CYDY can takes weeks to negotiate some buyout or other such thing.
