Alright, let's try this again.
Kosmos contested Total's contract and the litigation took years and was tried in 3 different jurisdictions.
Each jurisdiction ruled differently or not at all in the case of Texas because there Kosmos pulled out.
Now PLEASE LISTEN...
they have two choices. They can either go back to the litigation and schedule a court date as you suggest OR they can work something out among themselves.
1) So to my knowledge NO to your first question because it appears they've been spending all this time since the end of the litigation working on a deal to resolve it.
However, with Kosmos cash strapped, with litigation costs more than ERHC's market cap to go back to court, and with Kosmos leaving most of the EEZ, it would seem reasonable to assume that Kosmos would much rather work this out without further litigation.
2) Yes. Final judgements were entered... the judgements were contradictory from competing jurisdictions. See 400 page document.
3) short sellers are screwed because I don't see a scenario here where they are not. That's why it matters.
