I think they can. The news is public. Of course, there are other reasons they may not be able to buy.
Then again a public company could have a defined benefit plan set up so insiders and employees etc could purchase stock regardless. Definite lack of forward thinking to not have such a vehicle set up. Generex or NGIO. Especially since NGIO isn't trading yet. Get a plan in place so it isn't an issue later.
Also since GNBT's S-1 has been cleared, why have we not seen purchases by any insiders?
