ohm, you are on the right path, patterson probably had to come up with an alternative way of doing the occupancy test in order to side step existing patents/methods. That patterson process could easily have been rejected as "not qualified" by the FDA.

Of course it could also be nader speak and we know that is a moving target of obfuscation...
