I agree. But I believe that was Joe's intent all along. Get the S-1 out there, ensure that it clears the SEC without comment because they would already have that aspect in the bag. File with the updated 10-K once ALL aspects of the listing are lined up.
In fact, I believe they are going to wait until the 10-K is cleared without SEC comment before they file those S-1A's. They wouldn't want to chance filing and picking a date only to have to resubmit once again.
