I'm just going by what is written in this FDA doc titled: Guidance for Clinical

I agree that trial sponsors pay for the trials and therefore can ultimately do what they want with the data. Perhaps that document is more guidance than law during the pandemic? Not sure - I'm just paraphrasing what it says.
