That information wasn't provided in a timely enough manner to satisfy the SEC, so they felt the need to publicize the (I believe damning) letters proving just that.

And the form EFFECT has never appeared, so Joe can say or PR whatever he wants. I'll believe it when I see the Form EFFECT on the Edgar site... I just checked again, and it's not there.
