Frip, that's a misreading of the Nasdaq rules.
The last clause you invoke is "Backup and final disposition documents must be provided."
What it means is that final disposition documents must be provided IF they exist.
If NASDAQ meant that an open lawsuit disqualifies an applicant, and that any lawsuit must already be concluded, they would have just said that directly.
