So it looks to me like the court was not saying the plaintiff's case is without merit. It's more that the injunction put undue strain on Generex, and therefore wasn't a viable remedy.
So they threw it all back to the arbitrator, where we might effectively lose the case, but we won't be without the option of issuing stock.
So the way I see it, there may be repercussions later, but this is a very good development overall.
Any attorneys out there want to weigh in?
